These Terms and Conditions ("Terms") govern your access to and use of The Visionary Protocol online course and related materials (the "Course") supplied by Petida Pty Ltd (ABN 52 615 486 685) ("we", "us", "our"), trading as Peter Ostick / The Visionary Protocol. By purchasing, accessing, or using the Course, you ("you", "your", the "Participant") agree to these Terms. If you do not agree, do not purchase or use the Course.

## 1. About the Course

1.1 The Visionary Protocol is a self-paced online educational and personal development program delivered digitally, comprising video sessions, written materials, exercises, and guided practices, together with any coaching, sessions, or additional services described at the point of purchase.

1.2 We may update, improve, or modify the Course content from time to time. We will use reasonable efforts to ensure continuity of access to material of equivalent value.

## 2. Eligibility

2.1 You must be at least 18 years of age to purchase and use the Course.

2.2 By purchasing, you confirm that the information you provide is accurate and that you have authority to accept these Terms.

## 3. Purchase, Pricing and Payment

3.1 Prices are listed in Australian Dollars (AUD) and, unless stated otherwise, are inclusive of GST where applicable.

3.2 Payment is processed at the time of purchase through our third-party payment provider. We do not store your full card details.

3.3 Where a payment plan is offered, you authorise us to charge the agreed instalments to your nominated payment method on the scheduled dates. If a payment fails, we may suspend your access until the outstanding amount is paid.

3.4 We reserve the right to change pricing at any time. Changes do not affect purchases already completed.

## 4. Access and Licence

4.1 On purchase, we grant you a personal, non-exclusive, non-transferable, revocable licence to access and use the Course for your own personal, non-commercial use.

4.2 Access is provided on a lifetime basis, meaning for so long as we continue to make the Course available. We will give reasonable notice if we intend to discontinue the Course, and will use reasonable efforts to provide continued access to material of equivalent value.

4.3 Your login credentials are personal to you. You must not share, resell, or provide access to any other person. We may suspend or terminate access if we reasonably believe credentials are being shared or the Course is being used in breach of these Terms.

## 5. Intellectual Property

5.1 All content in the Course, including videos, text, frameworks, exercises, graphics, and the name "The Visionary Protocol", is owned by or licensed to us and is protected by intellectual property laws.

5.2 You may not copy, reproduce, distribute, publish, adapt, record, resell, or create derivative works from any Course material, or use it to build or deliver a competing product or service, without our prior written consent.

5.3 The limited licence in clause 4 does not transfer any ownership of intellectual property to you.

## 6. Refunds and the Threshold Guarantee

6.1 **Australian Consumer Law.** Nothing in these Terms excludes, restricts, or modifies any guarantee, right, or remedy you have under the Australian Consumer Law (ACL) that cannot lawfully be excluded. Our goods and services come with guarantees that cannot be excluded under the ACL. The Threshold Guarantee below is offered in addition to, and does not limit, those rights.

6.2 **The Threshold Guarantee.** In addition to your rights under the Australian Consumer Law, we offer the Threshold Guarantee. To claim it, you must, within 14 days of your purchase, have worked through the first two sessions of the Course, including their exercises, and email us in writing at [email protected] within that same 14-day period stating that you do not feel the protocol is going to take you somewhere real. Where you meet these conditions, we will refund your fee in full. The Threshold Guarantee is available once per person. This guarantee does not apply where you have not worked through the first two sessions and their exercises, or where your request is made more than 14 days after your purchase; your rights under the Australian Consumer Law are not affected.

6.3 Except as required by the ACL or as expressly provided by the Threshold Guarantee, all sales are final and fees are non-refundable, including because you change your mind, do not complete the Course, or do not achieve a particular result.

## 7. No Guarantee of Results

7.1 The Course is educational and developmental in nature. Any examples, testimonials, or case studies describe individual experiences and are not a promise or guarantee that you will achieve similar results.

7.2 Your results depend on many factors within your own control, including your effort, circumstances, and application of the material. We do not guarantee any specific outcome, financial or otherwise.

## 8. Not Professional Advice — Health, Wellbeing and Financial

8.1 The Course, including any breathwork, meditation, movement, or contemplative practices, is provided for general educational and personal development purposes only. It is not medical, psychological, psychiatric, therapeutic, health, legal, or financial advice, and it is not a substitute for advice from a qualified professional.

8.2 Some practices may not be suitable for everyone. You should consult a qualified medical practitioner before beginning any breathwork, movement, or other physical or psychological practice, particularly if you have any medical condition, are pregnant, or have any history of cardiovascular, respiratory, or mental health conditions.

8.3 You participate in all practices voluntarily and at your own risk. You are responsible for your own health, wellbeing, and decisions. If you experience distress or a medical issue, stop and seek appropriate professional support.

8.4 Nothing in the Course is financial product advice or a recommendation to make any investment or financial decision.

## 9. Your Conduct

9.1 You agree to use the Course lawfully and not to misuse, disrupt, or attempt to gain unauthorised access to our systems or content.

9.2 Any community, group, or coaching interaction must be respectful. We may remove you from any such component, without refund, for abusive, harassing, or unlawful conduct.

## 10. Third-Party Platforms

10.1 The Course is delivered via third-party platforms (including [e.g. Kajabi] for hosting and [payment provider] for payments). Your use of those platforms may also be subject to their terms. We are not responsible for the acts or omissions of third-party providers.

## 11. Limitation of Liability

11.1 To the maximum extent permitted by law, and subject to clause 6.1, we are not liable for any indirect, incidental, special, or consequential loss, or for any loss of profit, revenue, opportunity, or data, arising from or in connection with the Course.

11.2 To the maximum extent permitted by law, and subject to clause 6.1, our total liability to you for any claim arising out of or in connection with the Course is limited, at our option, to re-supplying the Course or the relevant part of it, or refunding the fees you paid for it.

11.3 Where liability cannot be excluded but can be limited under the ACL, our liability is limited as permitted by the ACL.

## 12. Indemnity

12.1 You agree to indemnify us against any loss or liability we suffer arising from your breach of these Terms or your unlawful or negligent use of the Course, to the extent permitted by law and except to the extent caused by us.

## 13. Privacy

13.1 We collect and handle your personal information in accordance with our Privacy Policy [LINK TO PRIVACY POLICY] and the Privacy Act 1988 (Cth). By purchasing, you consent to that handling.

## 14. Suspension and Termination

14.1 We may suspend or terminate your access if you breach these Terms, without refund except as required by law.

14.2 On termination, your licence to use the Course ends and you must stop using and delete any downloaded materials.

## 15. Changes to These Terms

15.1 We may update these Terms from time to time. The current version will be posted at [URL]. Changes apply to purchases made after the change. Continued use of the Course after changes are posted constitutes acceptance.

## 16. Governing Law and Jurisdiction

16.1 These Terms are governed by the laws of New South Wales, Australia.

16.2 You and we submit to the non-exclusive jurisdiction of the courts of New South Wales and the courts competent to hear appeals from them.

## 17. General

17.1 If any provision of these Terms is found to be invalid or unenforceable, it is severed and the remaining provisions continue in force.

17.2 A failure by us to enforce a provision is not a waiver of it.

17.3 These Terms are the entire agreement between you and us in relation to the Course and supersede any prior representations, except as required by law.
